In New South Wales, a Will must comply with the requirements of the Succession Act 2006 to be valid. If the will does not meet the requirements of the Act, or if the will is invalid for reason of lack of testamentary capacity, fraud, knowledge and approval or undue influence, a person’s estate will pass according to the rules of intestacy. To ensure your wishes are followed, and to avoid the costs and delay of court proceedings, make your will with us. All wills prepared by Wollongong Wills & Estates Lawyers comply with the Act, are reasonably priced and can be prepared quickly to ensure your testamentary affairs are in order.

Whilst a Will sets out what is to happen with with your estate after your death, there may become a point during your lifetime where you lose the capacity to make financial or health decisions for yourself. Making a Power of Attorney or Appointing a Guardian now ensures that you decide on who will handle these financial and health decisions (and not a court or tribunal).
